Terms and Conditions (T&C) of Montvellin
1. Scope of Application
These General Terms and Conditions (T&C) apply to all orders placed through our website. The offer on this website is exclusively directed at consumers residing in Switzerland (hereinafter referred to as the "Customer"). A consumer is defined as a natural person maintaining business relations with Montvellin that cannot be attributed to their commercial or independent professional activity. Orders in non-household quantities may be rejected without justification.
Montvellin reserves the right to amend these T&C at any time. The version valid at the time of the order shall apply and cannot be unilaterally changed for that order. Any terms and conditions of the Customer that conflict with or deviate from these T&C will not be recognized.

2. Information on this Website
Montvellin provides information about products and services on this website. Price and assortment changes as well as technical modifications remain reserved.
All information on www.montvellin.com (product descriptions, images, illustrations, videos, measurements, weights, technical specifications, accessory relations, and other details) serve illustration purposes only and are non-binding. They do not represent guaranteed characteristics unless explicitly stated otherwise.
Montvellin strives to present all information and data accurately, completely, and up to date, but provides no express or implied warranty thereof.
All offers on this website are non-binding and should not be considered a binding offer. Montvellin cannot guarantee that the products listed will be available at the time of ordering. Therefore, all statements regarding availability and delivery times are without guarantee and may change at any time without prior notice.
3. Prices
All prices listed by Montvellin are final prices and include statutory VAT and any other applicable taxes or fees (e.g., recycling fees or copyright levies on electronic devices), unless stated otherwise.
Prices are quoted net in Swiss Francs (CHF). Shipping costs are charged additionally, unless otherwise stated, and must be paid by the Customer.
Shipping costs are displayed separately during the checkout process.
Technical modifications, errors, and misprints are reserved. Montvellin may change prices at any time without prior notice.
Consulting and support services are not included in the sales prices.
4. Conclusion of Contract
The products and prices displayed on this website are non-binding offers.
By placing an order via this website, including acceptance of these T&C, the Customer submits a legally binding offer to conclude a contract.
Montvellin then sends an automatic order confirmation by email, confirming receipt of the Customer’s offer.
Orders are binding for the Customer.
The right of withdrawal is 30 days.
The contract is concluded once Montvellin sends a written confirmation via email confirming the order of the products or services.
Orders are shipped only after full payment has been received (except for purchases on invoice) and provided that the products are available.
If the ordered goods cannot be delivered or only partially delivered, Montvellin reserves the right to reject the order in whole or in part. In such cases, the Customer will be notified by email.
If payment has already been received, it will be refunded. If no payment has been made yet, the Customer is released from the payment obligation.
5. Payment Options and Retention of Title
The Customer can choose from the payment methods indicated during the checkout process.
Montvellin reserves the right to exclude Customers from specific payment methods without justification or require prepayment.
In the event of late payment, Montvellin may charge default interest of 5% per year and a reminder fee of up to CHF 20 per reminder.
6. Delivery, Inspection, Notification of Defects, and Returns
Deliveries are shipped by post or courier to the address provided by the Customer in the order.
Montvellin strives to maintain short delivery times. However, any delivery times stated in the order confirmation are non-binding.
Partial deliveries are permitted. Shipping costs will be charged only once in such cases.
Invoices (if offered as a payment method) may be sent by email or post at Montvellin’s discretion.
If a delivery cannot be completed or is refused by the Customer, Montvellin may cancel the contract after notifying the Customer by email and setting a reasonable grace period.
The Customer is obliged to inspect the goods immediately upon receipt and report any defects in writing by letter or email to the address stated in the imprint.
Returns to Montvellin are at the Customer’s expense and risk.
Goods must be returned in their original packaging, complete with all accessories, and accompanied by the delivery note and a detailed description of the defect.
If inspection reveals no defect or the defect is not covered by warranty, Montvellin may charge the Customer for the handling, return, or disposal costs.
7. Right of Withdrawal
The Customer has a 30-day withdrawal period after receiving the goods.
The deadline is met if the written withdrawal is sent to Montvellin by email or letter (address as stated in the imprint) within 30 calendar days.
The withdrawal does not require justification. Exercising the right of withdrawal leads to contract reversal.
The Customer must return the goods within 30 calendar days in their original packaging, complete with all accessories and the delivery note.
Returns are at the Customer’s cost and risk.
Any payment already made will be refunded within 20 calendar days after Montvellin receives the goods or the Customer provides proof of dispatch.
Montvellin reserves the right to deduct compensation for damage, excessive wear, or loss of value caused by improper handling.
No right of withdrawal is granted in the following cases:

Contracts involving fluctuating prices beyond the supplier’s control

Goods that are not suitable for return due to their nature or are perishable

Goods made to the Customer’s specifications or clearly personalized

Digital content not supplied on a tangible medium or services fully performed with the Customer’s prior consent before the withdrawal period expires

Accommodation, transportation, catering, or leisure services performed at a specific time or within a defined period.
8. Warranty
Montvellin endeavors to supply products of flawless quality.
For defects reported in due time, Montvellin provides a warranty for defect-free and functional goods for the statutory period (usually two years from the delivery date).
Montvellin may fulfill the warranty by repair, replacement, or refund at its discretion.
Further warranty claims are excluded.
The warranty does not cover normal wear and tear, improper handling, damage by the Customer or third parties, or defects due to external circumstances.
Consumable and wear parts (e.g., batteries, straps) are excluded.
Montvellin provides no assurance or guarantee for the constant availability, correctness, or completeness of data on this website, nor for uninterrupted access or error-free operation.
9. Liability
Montvellin excludes any liability, regardless of legal basis, for damages or claims against Montvellin or its auxiliaries.
In particular, Montvellin is not liable for indirect or consequential damages, loss of profit, or other personal, property, or financial damages of the Customer.
Mandatory statutory liability (e.g., for gross negligence or unlawful intent) remains reserved.
Hyperlinks on this site are provided solely for convenient access; Montvellin assumes no responsibility for the content of third-party websites.
10. Data Protection
Montvellin may process and use data collected during the order process to fulfill contractual obligations and for marketing purposes.
Necessary data may be shared with service partners (e.g., logistics providers) as required for order fulfillment.

11. Severability Clause
If any provision of these T&C proves to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
12. Further Provisions
Montvellin expressly reserves the right to modify these T&C at any time and to enforce them without prior notice.
In case of disputes, Swiss substantive law shall apply exclusively, excluding conflict-of-law provisions and the UN Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction is 6020 Emmenbrücke, Switzerland, or the Customer’s place of residence.
